ELV Regulation adopted: recycled plastic quotas reach the car industry

On 29 June 2026 the Council of the European Union formally adopted the regulation on circularity requirements for vehicle design and the management of end-of-life vehicles. It is the first time recycled content quotas have been written into law for a sector as large and as globally organised as automotive, and the mechanism it uses is more interesting than the headline numbers: a portion of the recycled plastic in a new car must come from old cars.

The route to adoption

Council and Parliament reached a provisional political agreement on 12 December 2025. Coreper endorsed it on 25 February 2026. The Council adopted the regulation formally on 29 June 2026.

The targets themselves are staged from entry into force rather than from adoption: at least 15% recycled plastic in new vehicles after six years, rising to 25% after ten. At least 20% of that recycled plastic must be recovered from end-of-life vehicles.

Why the closed-loop clause is the substantive part

A plain recycled content target can be met with whatever recyclate is cheapest on the market. That improves the numbers on a compliance report without necessarily improving anything upstream, because the material would have been recycled anyway and has simply been redirected.

Requiring a fifth of the recycled plastic to come from end-of-life vehicles changes that. Automotive plastics from dismantling are today largely destined for low-value applications or energy recovery: they are mixed, often filled or reinforced, and carry decades of additives. Creating regulatory demand for exactly that stream forces investment into separating and upgrading it — work nobody would fund on current market economics.

It also insulates the rest of the recyclate market. Without the clause, automotive demand for technical rPP and rHDPE would land squarely on the same constrained supply that packaging and construction already compete for. With it, at least a fifth is sourced from a stream nobody else was using.

The rest of the regulation

Beyond recycled content, the regulation introduces a vehicle circularity passport documenting materials and components throughout each vehicle’s life. It tightens traceability of end-of-life vehicles and adds measures against illegal exports and so-called missing vehicles — the substantial share of cars that disappear from registers without ever reaching an authorised treatment facility.

Scope was extended at the Council’s insistence to two- and three-wheel vehicles and quadricycles, which previous end-of-life vehicle legislation did not cover. Future recycled content targets for steel, aluminium and critical raw materials remain possible.

What has to exist for this to work

Three things, none of which is in place today at the required scale.

Separation at dismantling. Recovering usable polymer streams from a vehicle requires taking parts off in a controlled sequence rather than shredding the whole shell. That is more labour and more space per vehicle.

Upgrading capacity. Automotive plastics need processing to technical specification, which is harder than producing packaging-grade material and currently commands prices that do not obviously justify it — black rPP pellets were assessed at EUR 960–970 per tonne at the end of June 2026, down 3.3% month on month.

Traceability. Proving that 20% of the recyclate came from end-of-life vehicles requires documentation following the material from dismantler to compounder to moulder. The circularity passport is the instrument intended to carry that.

A caution on dates

The six- and ten-year clocks run from entry into force, which follows publication in the Official Journal, not from the 29 June adoption. Any figure naming a specific calendar year for the 15% target is currently an estimate. The regulation is adopted; it is not yet in force.
